Title 16 › Chapter CHAPTER 12D— - COLUMBIA BASIN PROJECT › § 835g
If a project needs land where an Indian cemetery is located, the Secretary of the Interior may, instead of paying for that land, choose and buy other land for new cemeteries and move bodies, markers, and other items to the new sites. The project must pay all relocation costs. When the Secretary authorizes the move, the tribe’s rights in the old cemetery end and the property transfer described in sections 835d–835h takes effect. The new cemetery sites will be held in trust by the United States for the Spokane or Colville Tribe, and they will not be subject to taxation.
