Defines the key words used in this chapter so people know what they mean for the Treaty and related rules. Administrator: the person or group chosen by the Pacific Island Parties to act for them and told to the U.S. government. Authorized Officer: an officer allowed by the Secretary, by the secretary of the department that runs the Coast Guard, or by a federal or state agency with an enforcement agreement with the Secretary. Authorized Party Officer: an officer chosen by a Pacific Island Party to enforce the Treaty. Applicable national law: a Pacific Island Party’s law that is officially noticed and in effect under the Treaty. Closed Area: an area a Pacific Island Party has closed to vessels under its law and has noticed under the Treaty. Fishing: searching for, catching, trying to catch, using fish-aggregating devices, or any sea operations that support those activities, except for safety or medical emergencies. Fishing vessel: a U.S.-documented boat used for or normally used for commercial purse seine tuna fishing. Licensing Area: waters under a Pacific Island Party except internal waters, territorial seas, archipelagic waters, and Closed Areas. Licensing period: how long a license is valid. Operator: the person who runs or controls a vessel, including owner, charterer, or captain. Pacific Island Party: a Pacific Island country that is a party to the Treaty. Person: any individual, company, or government entity. Regional terms and conditions: terms the Administrator adds to a license and the Secretary announces. Secretary: the Secretary of Commerce or that person’s designee. State: the 50 States, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, the U.S. Virgin Islands, Guam, and any other U.S. territory or possession. Treaty: the fisheries agreement between certain Pacific Island governments and the U.S., signed in Port Moresby, Papua New Guinea on April 2, 1987, including its annexes, schedules, and implementing agreements.
