If a dispute requires creating an arbitration panel under the Treaty, the Secretary of State, after talking with the Secretary, must pick the United States’ arbitrator and choose where the arbitration will be held. The Secretary of State also speaks for the United States when agreeing with each Pacific Island Party on who will serve as the panel’s presiding arbitrator.
