§1101 Unauthorized fixation and trafficking in sound recordings and music videos

Title 17 › Chapter CHAPTER 11— - SOUND RECORDINGS AND MUSIC VIDEOS › § 1101

Last updated Apr 6, 2026|Official source

Summary

Makes it illegal for anyone to record a live music performance without the performers' permission, to make or reproduce copies from such an unauthorized recording, to broadcast the performance to the public, or to sell, rent, offer, or trade those copies — even if the recording was made outside the United States. The word "traffic" has the same meaning as in 18 U.S.C. 2320(e). The rule applies to acts on or after the date the Uruguay Round Agreements Act was enacted and does not cancel or limit state law rights or remedies.
