Courts must order a person convicted under this chapter to pay restitution to the victim, even if other penalties apply and even if other restitution rules (sections 3663 or 3663A) exist. The court must use the procedures in section 3664 (the same way orders under section 3663A are handled). Property forfeiture tied to this restitution follows section 413 of the Controlled Substances Act (21 U.S.C. 853), except subsection (d). "Full amount of the victim’s losses" follows section 2259(c)(2) and also includes the greater of the victim’s gross income/value to the defendant or the value calculated under the Fair Labor Standards Act (29 U.S.C. 201 et seq.). A "victim" is the person harmed, and for a child, someone incapacitated, or a deceased person it can be a guardian, estate representative, family member, or another court-appointed person, but never the defendant.
