Summary

People generally cannot sue NCMEC or its leaders, workers, or agents in federal or state court for work they do running the CyberTipline or for efforts to find child victims under the listed federal laws. Lawsuits or criminal charges are allowed, though, if NCMEC or its people did intentional wrongdoing; acted with actual malice; recklessly ignored a big risk of causing harm with no legal reason; acted for reasons unrelated to their child‑protection duties; or the act was just a normal business task like office work, driving, or managing staff. NCMEC must limit how many employees can see any images it gets under section 2258A, and it must permanently destroy those images when a law enforcement agency tells them to.
