It is illegal for anyone to knowingly make, get, send, receive, have, import, export, use, or threaten to use explosive or incendiary rockets or missiles that can home in on or be guided to an aircraft, the launchers or guidance devices for those weapons, or parts made to build them. The rule does not cover devices that are not designed to be weapons. It also does not apply to actions by the U.S. or state governments or work done under a government contract. The rule applies when the crime affects interstate or foreign commerce; happens outside the U.S. by a U.S. citizen; targets a U.S. citizen abroad; involves U.S. property anywhere; or involves helping or planning with someone covered by this rule. Breaking it, trying to break it, or planning it can bring a fine up to $2,000,000 and at least 25 years or life in prison. Using or threatening the items during the crime raises the minimum to 30 years or life. If the crime causes a death, the penalty can be life in prison and a fine up to $2,000,000. Aircraft is defined in federal law (49 U.S.C. 40102(a)(6)).
