Federal or certain state and local judges and magistrates where a person is found can have that person arrested for a federal crime. The United States pays the cost. The person may be held or released as allowed under chapter 207 so they can go to the federal court that handles the case. The arrest papers and signed promises from witnesses to appear must be sent quickly to the court clerk. U.S. judges and magistrates must follow rules made by the Supreme Court of the United States. State judges may use their usual state procedures, but their orders only decide, under section 3142, whether to hold the person, release them with conditions before trial, or end the arrest.
