Each district court clerk must gather the data and make the statistics listed in sections 3166(b) and 3166(c). They must use forms and follow rules set by the Administrative Office of the U.S. Courts, approved by the Judicial Conference and after consulting the Attorney General. Clerks may get the needed information from the U.S. Attorney, the Federal Public Defender, private defense lawyers in the district, district judges, and the chief federal probation officer. They do not have to provide confidential or privileged material. The finished data must be shared with the district court, the planning group, the circuit council, and the Administrative Office of the U.S. Courts.
