Title 18 › Part PART II— - CRIMINAL PROCEDURE › Chapter CHAPTER 228— - DEATH SENTENCE › § 3597
When a U.S. marshal is in charge of carrying out a death sentence, the marshal may use state or local buildings and the help of state or local officials or people they hire. The marshal must pay those costs in an amount the Attorney General approves. No employee of a State corrections department, the Department of Justice, the Federal Bureau of Prisons, the U.S. Marshals Service, or a contractor working for them can be forced, as part of their job or contract, to attend or take part in any prosecution or execution if it goes against their moral or religious beliefs. "Participation in executions" includes preparing the condemned person, preparing the equipment used, and supervising others doing those tasks.
