§4006 Subsistence for prisoners

Title 18 › Part PART III— - PRISONS AND PRISONERS › Chapter CHAPTER 301— - GENERAL PROVISIONS › § 4006

Last updated Apr 6, 2026|Official source

Summary

The Attorney General or the Secretary of Homeland Security must pay only the actual, reasonable costs to house, feed, and care for prisoners held by any U.S. marshal. They must create rules so marshals can figure and document those real expenses. For health care for people held by the U.S. Marshals Service, the FBI, or the Department of Homeland Security, the government will pay the billed amount but not more than what Medicare would pay for the same care under title XVIII of the Social Security Act. That payment is final.
