If a defendant files a Rule 12.2 notice saying they will use insanity and the Government asks, the court must order a mental-health exam and file a report under 4247(b)–(c). If the insanity issue is raised, the jury or the judge must find the defendant guilty, not guilty, or not guilty only by reason of insanity.
