A hospital director must tell the court if a person in federal custody who is about to be released, who was committed under section 4241(d), or whose charges were dismissed only for mental-health reasons is now mentally ill and likely to hurt someone or seriously damage property, and if no state care is available. The director sends a written certification to the court clerk, who gives copies to the person and the government. The court then holds a hearing (and can order a psychiatric exam first). If the court finds by clear and convincing evidence that the person is dangerous because of a mental illness, the court must commit the person to the Attorney General. The Attorney General must try to get the person’s home state to take custody. If no state will take the person, the Attorney General must hospitalize the person until a state agrees or the person is no longer dangerous or can be safely released under a treatment plan. When the hospital director believes the person has recovered enough that release would not be dangerous, the director must tell the court. The court then either orders discharge or holds a hearing. If the court finds by a preponderance of the evidence that release is safe, it must discharge the person or order a conditional release with a required treatment plan. If the person fails to follow the treatment plan, the hospital must tell the Attorney General and the court; the person can be arrested and brought back to court quickly, which may return them to a hospital. "State" includes the District of Columbia. If charges were dismissed for non-mental reasons, the Attorney General must turn the person over to the state for civil commitment or release them within 10 days if the state refuses.
