Counterfeit coins, government money or securities (U.S. or foreign), and any items, machines, or materials used to make them found with someone who does not have permission from the Secretary of the Treasury or another proper officer must be turned over to the United States. If a person who has custody of those items refuses to hand them over when an authorized Treasury agent or other proper officer asks, they can be fined under federal law, jailed for up to one year, or both. If someone with an interest in seized items files a petition with the Secretary of the Treasury before the items are disposed, the Secretary may cancel or reduce the forfeiture if he finds there was no willful negligence, no intent to break the law, or other mitigating reasons, and may set conditions. If the seizure involves other crimes besides counterfeiting government money or papers, the petition is sent to the Attorney General, who may also cancel or reduce the forfeiture on reasonable terms.
