Makes it a federal crime to give, send, or try to give or send any papers, drawings, codes, photos, plans, maps, models, or other information about national defense to a foreign government, a group inside another country, or their agents when you mean or should believe it will hurt the United States or help the foreign side. The crime can be punished by death or by imprisonment for any number of years or for life. The death penalty can only be used if a jury or judge finds the act led to the exposure and death of a U.S. agent, or if the information directly involved nuclear weaponry; military spacecraft or satellites; early warning systems or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy. In time of war, it is also a crime, punishable by death or long prison terms, to collect or share information meant for the enemy about the movement, numbers, condition, or plans of U.S. forces, ships, aircraft, war materials, defenses, or any other public defense information that could help the enemy. If two or more people plan to break this law and one of them takes a step to carry out the plan, all of them face the same punishment. Anyone convicted must forfeit to the United States, regardless of state law, any money they gained from the crime and any property used or meant to be used to commit it. The court must order the forfeiture. The rules in section 413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21 U.S.C. 853(b), (c), and (e)–(p)) apply to that property and any related seizures or legal proceedings. After lawful expenses, amounts from the forfeiture must be deposited into the Crime Victims Fund in the Treasury, notwithstanding section 524(c) of title 28.
