During a war when the United States is neutral, the President or someone he allows can hold any armed ship owned wholly or partly by U.S. citizens, or any domestic or foreign ship (except official U.S. government ships) that is clearly built or changed for fighting. The ship can be kept until the owner or captain proves, to the President or his designee, that the ship will not be used to attack people or property of a foreign country at peace with the U.S., and will not be sold or given to a nation at war or its agents, inside U.S. waters or on the high seas. Anyone who illegally takes, tries to take, or lets someone take such a detained ship out of port or out of the United States can be fined under federal law, imprisoned for up to 10 years, or both. The ship, its gear, and its cargo will also become the property of the United States.
