The Secretary of the Treasury can move seized vessels, vehicles, aircraft, merchandise, or baggage to another customs district for sale if state law bans a sale where they were seized or if a sale would get a better price elsewhere. A court can, when asked by the Secretary, order that seized items be handed to the Secretary for handling. If sale proceeds won’t cover costs, the Secretary can order destruction. If the goods are illegal to sell or use under U.S. or state law, the Secretary may destroy them or have them remade into a legal product, and any money from that must go to the United States.
