Summary

When giving help under sections 1913 and 1914, the Secretary can sue or be sued in state courts or U.S. district courts, and the federal district courts can hear the case regardless of the amount. He or his property cannot be seized, and these activities remain subject to 28 U.S.C. §§517, 519, and 2679.

Title 19, §1920

In providing technical and financial assistance under section 1913 and 1914 11 See References in Text note below. of this title, the Secretary of Commerce may sue and be sued in any court of record of a State having general jurisdiction or in any United States district court, and jurisdiction is conferred upon such district court to determine such controversies without regard to the amount in controversy; but no attachment, injunction, garnishment, or other similar process, mesne or final, shall be issued against him or his property. Nothing in this section shall be construed to except the activities pursuant to section 1913 and 1914 1 of this title from the application of section 517, 519, and 2679 of title 28.
