§3907 Enforcement

Title 19 › Chapter CHAPTER 25— - CLEAN DIAMOND TRADE › § 3907

Last updated Apr 6, 2026|Official source

Summary

Imposes penalties for breaking rules about rough diamonds. A civil fine up to $10,000 can be charged for violating or trying to violate any license, order, or rule under this law. If someone willfully violates or willfully tries to violate those rules, they can be fined up to $50,000, and a natural person can be jailed up to 10 years, or both. Corporate officers, directors, or agents who join in a willful violation can get the same punishments. U.S. customs laws, including seizure and forfeiture rules, apply to illegally imported rough diamonds. The United States Bureau of Customs and Border Protection and the United States Bureau of Immigration and Customs Enforcement may enforce these penalties and the export rules, including checking that the exporting authority validated the Kimberley Process Certificate.
