The United States Secretary must make U.S. requests for binational panel review of final decisions by a competent investigating authority under article 10.12. Competent investigating authority: the trade-investigating agency in a USMCA country (see article 10.8). United States Secretary: the U.S. official named in article 10.16. A person (see paragraph 5 of article 10.12) may ask for panel review by filing with the United States Secretary within the time in paragraph 4 of article 10.12. The Secretary’s receipt counts as the official request. Filing the request does not affect any challenge to its basis. The Secretary must send a copy of the request to all people who, under the importing country’s law, could have started a court review.
