Summary

The Executive Director must, with the Board’s approval, make rules about how the Office and its hearing officers run. The rules can be changed the same way. The rules must follow the procedures in section 553 of title 5. The Executive Director must give a general notice under 553(b), but send that notice to the Speaker of the House and the President pro tempore of the Senate for publication in the Congressional Record instead of the Federal Register. There must be at least a 30-day comment period after that publication. After adopting rules, the Executive Director must send notice and the rules to those leaders for publication in the Congressional Record on the first day both Houses are in session. Rules take effect when they appear in the Congressional Record.
