When a case under section 1407 or 1408 raises a question about a regulation from this chapter, the court can decide if that rule is valid using parts (A) through (D) of section 706(2) of title 5. If the rule was approved by joint resolution under section 1384(c), only section 706(2)(B) applies. If the court finds the regulation invalid, it must use, as needed, the most relevant executive agency regulation created to carry out the same statute. Except for what is described here, courts may not review regulations made under this chapter.
