The Architect of the Capitol must include a liquidated-damages clause in any construction contract worth more than $50,000. If a contractor causes a delay, they must pay a set daily amount for each day the project is late. Daily rates are $140 for contracts over $50,000 and under $100,000; $200 for $100,000 to $500,000; and for contracts over $500,000 the rate is $200 plus $50 for each $100,000 above $500,000. A contracting officer can change the rate in writing. The rule applies to contracts from fiscal year 2002 onward.
