At the first meeting of Congress after a general election, any Member of the House must give the oath to the Speaker. Then the Speaker must give the oath to all Members and Delegates present and to the Clerk before any other business starts. Members and Delegates who arrive later must take the oath before they sit. Beginning with the Eightieth Congress and every Congress after, the Clerk must print the oath and give two copies to each person who has taken it. Each Member or Delegate must sign both copies in person and give them to the Clerk. One copy is kept in the House records and the other is put in the Journal and the Congressional Record. Those signed or certified copies can be used as proof in any U.S. court that the person properly took the oath.
