Pay increases for offices or jobs covered by subparagraphs (A), (B), (C), or (D) of section 356 must not start until the next Congress begins after the Congress that passed the increase. A law passed between the Tuesday after the first Monday in November of an even-numbered year and noon on January 3 is treated as if it was passed in the first session of the next Congress. Three exceptions do not follow that delay: increases that take effect under earlier sections of this chapter; increases tied to the Employment Cost Index (as determined under section 704(a)(1) of the Ethics Reform Act of 1989) or that replace such an index-based adjustment; and increases that take effect under section 702 or 703 of the Ethics Reform Act of 1989.
