The Speaker of the House can forgive all or part of a government claim for pay or allowances that were paid by mistake after July 25, 1974, to officers or employees whose pay is handled by the Chief Administrative Officer of the House. Travel and transportation payments are not included. A person must apply for the waiver, and the Chief Administrative Officer will investigate and send a written report to the Speaker. The Speaker cannot forgive a claim if there is any fraud, misrepresentation, fault, or bad faith by anyone involved, or if the application arrives more than 3 years after the mistake was discovered. Waived amounts get full credit in audits and are treated as valid payments. The Speaker must make rules to run this process and this does not change other legal powers to handle claims.
