Allows the House or the Senate to set a bill’s PAYGO budget numbers by putting a short notice in the bill that points to a statement called “Budgetary Effects of PAYGO Legislation” put in the Congressional Record by the House or Senate Budget Committee Chair before the vote. For conference reports, both Chairs put in a joint statement. The Budget Committee Chair(s) can submit an estimate (and note any “current policy” adjustments under section 936) before passage; the latest statement before the vote controls if the bill is not later changed. If no valid statement exists, OMB will make the estimate when the law is enacted. The Chairs can ask CBO or OMB to exclude certain costs up to fixed limits under section 936. Any excess savings from those adjustments may only offset costs of other provisions in the same adjustment category. The Chair must explain these adjustments in the statement. OMB must keep and publish two public PAYGO scorecards showing yearly budget effects over a 5-year period and a 10-year period, plus an add-on for emergency items. OMB uses the bill’s referenced numbers when available. If not, OMB estimates using the approaches and the same assumptions as the President’s most recent budget. Effects that occur in the current session year count as if they happened in the budget year. OMB averages cumulative effects across the 5 or 10 years (divide by 5 or 10 and put that number in each year). Net savings from the Community Living Assistance Services and Supports Act enacted or changed after February 12, 2010 are excluded. If Congress labels a provision an emergency, its budget effects are treated as emergency and are not counted on PAYGO scorecards; in the Senate a point of order can strike an emergency label unless three-fifths of Senators vote to keep it, with appeals limited to 1 hour.
