The Secretary of Education can waive or change rules that require states and local school districts to keep their spending levels when they suffer a sudden big drop in money. Those waivers can apply only to fiscal year 2009, 2010, or 2011. A waiver can be given only if the State still will not give a smaller share of its total state revenues to elementary, secondary, and public higher education in that year than it gave the year before. With the Secretary’s prior approval, a State or local agency may treat part of these federal funds as if they were non‑federal money for meeting spending‑level rules in other federal programs, including Part C of the Individuals with Disabilities Education Act. Even so, the required level of effort for the next fiscal year cannot be reduced.
