Recipients harmed by final agency actions under sections 1234a, 1234d, or 1234e, and States denied under section 1232d(a), may seek review in the U.S. Court of Appeals for their circuit. They must petition within 60 days. The clerk sends the petition to the Secretary, who files the record; the Secretary may not act until review ends. Office factual findings supported by substantial evidence are conclusive; the court may remand, and the Office may revise and file a new record. The court may affirm or set aside the action, in whole or part. Supreme Court review may occur under 28 U.S.C. 1254.
