By September 1, 2022, the Secretary of Education, the Secretary of Health and Human Services, and the Attorney General must set up a joint Task Force on Sexual Violence in Education. The Task Force must give information and advice to the Education Secretary, the Attorney General, Congress, and the public about preventing and responding to sexual violence on campuses. It must create consistent public complaint procedures for violations of Title IX (20 U.S.C. 1681 et seq.) and section 1092(f). The Task Force must also give schools recommendations on prevention and response teams; survivor resources (like health care, evidence kits, trained examiners, trauma-informed and culturally inclusive care, and advocacy); best practices developed with student groups; sex education, staff training, and fair discipline models; and ways to support survivors that account for race, gender identity, disability, immigration status, and other factors. It must get input from diverse survivors, advocates, trauma experts, and schools, consider whether the Department of Education can use intermediate fines under 20 U.S.C. 1682 and other remedies, and make a plan described below. Agencies funded under the Violence Against Women Act may detail staff to help the Task Force for up to 3 years, with or without reimbursement. Within 90 days after it starts, the Task Force must send Congress recommendations on recruiting, keeping, and training a strong Department of Education investigative workforce to handle Title IX and 1092(f) sexual violence cases, including gap assessments, retention ideas, outreach and training with law enforcement and schools, and research needs. The Task Force must publish an annual report with counts and timing of complaints and investigations. Educational institution means K–12 and higher education.
