A court may end an order that makes a school agency move students to fix an equal protection problem if the court finds the agency has met, and will keep meeting, the requirements of the Fifth or Fourteenth Amendment. The first court must explain why. The end is put on hold during any final appeal or until the time to appeal runs out. No new transport order can be made unless the agency is later found not to meet those constitutional requirements.
