Title 20 › Chapter CHAPTER 11— - NATIONAL ARBORETUM › § 196
The Secretary of Agriculture can make deals and run services at the National Arboretum to help its work. The Secretary may contract with nonprofit scientific or educational groups or other supporting nonprofits. Money those groups earn from such deals must be used only for research and education for the Arboretum and for operating, maintaining, and improving Arboretum facilities. The Secretary can also allow commercial food, drink, and plant sales after giving public notice and picking a qualified seller, sell excess property to get the best price (including auctions) but not change free sharing of new seed varieties under section 2201 of title 7, charge reasonable fees for temporary use or for commercial photography, publish informational materials without following federal printing rules, and license the Arboretum name and logo. Money collected goes into a special fund in the Treasury and can be spent for the Arboretum without extra approval. The Secretary may accept volunteers from those nonprofits and from individuals, including staff. A nonprofit with a concession may recognize donors if the Secretary approves, and the Secretary must give broad approval where federal law allows.
