The Secretary may hire the officers and employees needed to run the Department, including lawyers. These hires must follow the civil service rules and pay rules in title 5 unless another law says otherwise. At the Secretary’s request, the Director of the Office of Personnel Management must set up the same number of GS‑16, GS‑17, and GS‑18 jobs as were used for offices moved into the Department and filled on May 3, 1980. Some people moved with those jobs can be appointed without following one hiring rule if they held a similar job the day before May 4, 1980. That special hiring authority ends when the first person in the job leaves. The Director must also create 15 limited‑term Senior Executive Service slots. Those slots end on the later of three years after May 4, 1980 or three years after each first appointment. Any Indian preference law in effect the day before October 17, 1979 still applies to transferred offices that were covered by it.
