Summary

The Secretary can hire experts and consultants when appropriation Acts allow it. The hiring must follow the rules in section 3109 of title 5. These experts can be paid up to the daily rate set for GS–18 under section 5332 of title 5. The Secretary may use up to 1 percent of the funds for any education program that awards money by competition to pay fees and expenses of outside (non‑Federal) experts who review applications. That 1 percent rule does not apply to programs that already have authority to pay those reviewers.
