The Secretary can move jobs and change, combine, create, or close offices inside the Department, as long as the rules in section 3412(f) are followed. The Secretary may not change offices or duties that were set up by other laws and moved into the Department (unless subsection (b) allows it), may not abolish entities created by this chapter, and may not alter any specific delegations required by this chapter. Under subsection (b), the Secretary may consolidate, change, close, or reassign duties for a group of 12 named units (for example, the Office of English Language Acquisition; the Teacher Corps; the Community College Unit; the National Center for Education Statistics; the National Institute of Education; the Office of Indian Education; and others). Before doing so, the Secretary must send a full written notice with facts and reasons to the Senate Committee on Labor and Human Resources and the House Committee on Education and Labor and wait 90 days after those committees receive the notice.
