If someone gets a grant under section 3604 or a loan under section 3605, they must let the United States sue, on their behalf, anyone the Attorney General finds owes money for the costs of the work paid for by that grant or loan. Money recovered in any such lawsuit (whether the United States sues or the recipient sues on its own) must be used to repay the United States: the amount of the grant, the unpaid balance of the loan, and interest equal to what a commercial lender would have charged at prevailing rates as the Secretary decides. The Attorney General must investigate whether the United States should try to recover amounts spent under this chapter and must send Congress a report with findings and recommendations within one year after June 14, 1980. If the Attorney General decides to seek recovery, the Attorney General must act quickly to get those funds from the responsible persons.
