Defines key words used in this chapter. Asbestos means the minerals chrysotile, amosite, and crocidolite, and in fibrous form it also includes tremolite, anthophyllite, and actinolite. Attorney General means the U.S. Attorney General. Imminent hazard to the health and safety, for section 3605, means asbestos that, under standards the Secretary sets, is crumbly or easily damaged, or is within students’ reach or likely to be harmed (including by water or air movement) so it could release asbestos fibers into the school. Local educational agency means the local education agency named in the Elementary and Secondary Education Act or the governing body of a nonprofit elementary or secondary school. Nonprofit elementary or secondary school means a school run by nonprofit organizations that do not benefit private owners, and any school run by a U.S. agency. School buildings means classrooms, labs, libraries, food service and prep areas, gyms for PE, other teaching/research/administration spaces, and their needed maintenance, storage, or utility areas. Secretary means the Secretary of Education or a designee. State lists the several States, the District of Columbia, Puerto Rico, Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, the Bureau of Indian Affairs, and the Department of Defense’s Office of Overseas Schools. State educational agency has the same meaning given in ESEA section 198(a)(17).
