The Secretary must set aside parts of the yearly program money for specific uses. First, enough to continue existing subgrants. Second, up to 1 percent for national activities like technical help or a national evaluation. Third, up to 1 percent for the outlying areas and the Bureau of Indian Education, split based on need. The money left after these reserves is split among the States. Each State gets the same share of that remainder that it had under subpart 2 of part A of subchapter I in the prior year, but no State gets less than one-half of 1 percent of the total. If a State does not get an allotment, its share is reallotted to the other States. Each State must reserve at least 93 percent of its allotment for grants to eligible local entities. The State education agency may use up to 2 percent for administration, a rigorous peer-review of applications, and awarding funds. It may use up to 5 percent for monitoring, evaluations, training and technical help, making sure programs match State academic standards, building partnerships, coordinating funds, working with stakeholders, and keeping a list of prescreened external organizations.
