Local educational agencies that claim children living on Indian lands for funds under section 7703 must make and follow policies to protect those children’s rights. The policies must make sure the children can join programs equally, that parents and Indian tribes can give input and recommendations, that parents and tribes are involved in planning, that important applications and plans are shared with them, and that they can comment on the agency’s overall education program. The agency must keep records showing it followed these rules. If a tribe gives a written statement saying it is satisfied with the agency’s services, the agency does not have to follow these rules for that tribe for that fiscal year. The Secretary must give technical help and enforce these rules, which can include withholding funds under section 7703 after giving affected parties a chance to be heard. A tribe with students in a local agency can file a written complaint. Within 10 working days the Secretary must set a nearby hearing time and place, pick a hearing examiner, and notify everyone. The hearing must happen within 30 days, be public, and have a record. The examiner has 30 days after the hearing to write findings and recommendations for the Secretary. The Secretary then has 30 days to decide what remedies are needed and set a schedule, and must give copies to the tribe and the agency. The Secretary may combine similar complaints. If the agency refuses the decision or fails to act, the Secretary may withhold section 7703 funds until the remedy is done, with limited exceptions. If a tribe chooses services under section 1101(d) from the Bureau of Indian Education but some tribal students stay at the local agency, those students may still count for section 7703 funds and funds will not be withheld for them. These rules rest on the special relationship between Indian nations and the United States and do not remove any State duties to its citizens.
