The Secretary must give the Director the jobs needed to carry out this part of the law, except for office and support tasks. That does not change the National Assessment Governing Board’s role or power over the National Assessment of Educational Progress (including its testing methods) as it was on November 4, 2002, except for section 9621(e)(1)(J). Board members will still be chosen by the Secretary. Section 9621(f)(1) applies to the Board. Sections 9515 and 9516 do not apply to the National Assessment of Educational Progress or to the Board. The Secretary can also have the Institute run other activities if those activities match the Institute’s approved priorities and its mission under section 9516 and section 9511(b), or if they match the Institute’s mission but do not pull the Institute away from its priorities.
