The Secretary of Agriculture can set and collect fees to pay for agricultural quarantine and inspection work when people or goods arrive at U.S. ports or are precleared or preinspected outside the country. The fees must match the costs for the group paying them and can also cover the cost to run the fee program. Fees collected by others must be held for the U.S. and sent to the Secretary. Late payments get penalties and interest as required by section 3717 of title 31. A special user fee account was created to hold these fees through fiscal year 2002. For fiscal years 1996 through 2002, money in that account could be used, as appropriated, to pay for these services and administration; any fees over $100,000,000 in those years could be used without more appropriation. After September 30, 2002, leftover money and new fees go to the Agriculture Department accounts that pay the costs and remain available until spent. Full-time jobs paid from these fees do not count against certain federal hiring limits. The Secretary can also charge fees for animal quarantine work and veterinary diagnostics to cover costs. People who get these services must pay. If they do not, the Secretary can add penalties and interest, place a lien on the animals, articles, vehicles, or facilities, and stop providing services. The Secretary can sell property with a lien after notice. If sale money is more than the debt, the owner can claim the excess within 6 months; otherwise it goes to the accounts that paid the costs. The Secretary can make rules to run the fee programs and can sue in U.S. courts to collect unpaid fees. Defined terms in the section include "animal quarantine laws" (several federal animal and plant health laws), "customs territory" (the 50 States, the District of Columbia, and Puerto Rico), "person" (people and organizations), "United States" for animal rules (the States plus U.S. territories), and "vessel" (does not include ferries).
