The President may use the emergency powers in 50 U.S.C. 1702 and 1704 to carry out actions under this part. Within 180 days after April 24, 2024, and then every year, the President must send a report to the appropriate congressional committees about what the executive branch did under this part and about any national emergency on fentanyl trafficking or other illegal drug trade. The report must cover things like new or changed rules, sanctions, outside information collected, OFAC licensing actions, pending enforcement cases, and mitigation steps. The report should be unclassified, but details on collected information, OFAC licenses, enforcement cases, and mitigation may be in a classified annex.
