The Secretary of Health and Human Services must send a report to the Senate Committee on Health, Education, Labor, and Pensions and the House Committee on Energy and Commerce no later than 3 years after June 22, 2009, and at least every 2 years after that. The report must say how the Food and Drug Administration is doing with this part of the law (accomplishments, objective measures, and any parts not finished), list problems slowing progress or meeting time limits, give counts of new product applications under 387j and modified‑risk applications under 387k and how many were acted on, and show how many full‑time staff are working on it. The Comptroller General of the United States must, no later than 5 years after June 22, 2009, study and report to those same committees whether the Secretary has enough authority and resources and offer recommendations to better protect public health for tobacco manufacture, marketing, and distribution. Both reports must be made public, including posting on the FDA and Government Accountability Office websites.
