§10103 Reports to Congress

Summary

The President must send Congress a yearly report that lists every foreign person who was sanctioned under section 10102 during the past year. The report must say what type of sanctions each person got, how many people had sanctions added under 10102(a) and how many had sanctions ended under 10102(g), the dates those sanctions began or ended, the reasons for each action, and what the President is doing to get other countries to use similar sanctions. The first report was due within 120 days after December 23, 2016. After that, a report is due each year on December 10, or the next day when both Houses are in session; if the first report is sent before December 10 of that year, a report is still due on that December 10. The main report must be unclassified and made public (including in the Federal Register). A classified annex is allowed, but a person’s name can go into that annex only if the President finds it vital for national security, uses the annex consistent with congressional intent, and gives the appropriate congressional committees at least 15 days’ notice and a written justification if the name is kept classified despite public evidence of wrongdoing. The list must be published even if visa or entry records would normally be kept confidential under 8 U.S.C. 1202(f). The reports go to these committees: Senate — Appropriations; Banking, Housing, and Urban Affairs; Foreign Relations; Judiciary. House — Appropriations; Financial Services; Foreign Affairs; Judiciary.

(a)The President shall submit to the appropriate congressional committees, in accordance with subsection (b), a report that includes—
(1)a list of each foreign person with respect to which the President imposed sanctions pursuant to section 10102 of this title during the year preceding the submission of the report;
(2)a description of the type of sanctions imposed with respect to each such person;
(3)the number of foreign persons with respect to which the President—
(A)imposed sanctions under section 10102(a) of this title during that year; and
(B)terminated sanctions under section 10102(g) of this title during that year;
(4)the dates on which such sanctions were imposed or terminated, as the case may be;
(5)the reasons for imposing or terminating such sanctions; and
(6)a description of the efforts of the President to encourage the governments of other countries to impose sanctions that are similar to the sanctions authorized by section 10102 of this title.
(b)(1)The President shall submit the initial report under subsection (a) not later than 120 days after December 23, 2016.
(2)(A)The President shall submit a subsequent report under subsection (a) on December 10, or the first day thereafter on which both Houses of Congress are in session, of—
(i)the calendar year in which the initial report is submitted if the initial report is submitted before December 10 of that calendar year; and
(ii)each calendar year thereafter.
(B)Congress notes that December 10 of each calendar year has been recognized in the United States and internationally since 1950 as “Human Rights Day”.
(c)(1)Each report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex.
(2)The name of a foreign person to be included in the list required by subsection (a)(1) may be submitted in the classified annex authorized by paragraph (1) only if the President—
(A)determines that it is vital for the national security interests of the United States to do so;
(B)uses the annex in a manner consistent with congressional intent and the purposes of this chapter; and
(C)not later than 15 days before submitting the name in a classified annex, provides to the appropriate congressional committees notice of, and a justification for, including the name in the classified annex despite any publicly available credible information indicating that the person engaged in an activity described in section 10102(a) of this title.
(d)(1)The unclassified portion of the report required by subsection (a) shall be made available to the public, including through publication in the Federal Register.
(2)The President shall publish the list required by subsection (a)(1) without regard to the requirements of section 1202(f) of title 8 with respect to confidentiality of records pertaining to the issuance or refusal of visas or permits to enter the United States.
(e)In this section, the term “appropriate congressional committees” means—
(1)the Committee on Appropriations, the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the Committee on the Judiciary of the Senate; and
(2)the Committee on Appropriations, the Committee on Financial Services, the Committee on Foreign Affairs, and the Committee on the Judiciary of the House of Representatives.
