No property, money, or court award will be given back under this rule unless the official in charge or the court gets proof that the total fees paid to agents, lawyers, or other representatives for the return or payment will not be more than 10 percent of the value of the property or payment. If an agent, lawyer, or representative thinks fees should be over 10 percent, they can ask the U.S. district court where they live to allow higher fees and must name the officer or agency as the respondent. The court will approve more only for special circumstances of unusual hardship. Anyone who takes more than the approved fee, or keeps any excess for more than 30 days before getting approval, breaks this rule.
