No more than 10% of a claimant’s award can be paid to agents, attorneys, or representatives for their work, unless the Commission allows more under paragraph (b). Any agreement that tries to pay more is void. Anyone who asks for or gets more than the allowed amount, including if they know others were paid too, can be fined up to $5,000, jailed up to 12 months, or both. Within 3 months after the Commission finishes handling the settlement of all claims from the fund that paid the award, an agent, attorney, or representative can ask the Commission for permission to receive more than the 10%. The Commission will grant extra pay only if it finds unusual hardship that justifies it. The order will say how much extra can be paid. The Commission’s decision is final and cannot be reviewed by a court.
