For claims under section 1642c, owners can get paid or be denied depending on whether the company was a U.S. national when it was taken. If the company was a U.S. national, ownership-based claims are denied. If the company was not a U.S. national, direct owners can claim no matter how big their share was. Indirect owners can claim only if at least 25 percent of the company was owned by U.S. nationals at the time. Any payment is based on the company’s total loss and the claimant’s share of the whole company.
