The Commission must accept and decide claims from U.S. citizens for losses when the Government of Cuba (since January 1, 1959) or the Chinese Communist regime (since October 1, 1949) took or otherwise harmed property or property rights that were owned wholly or partly, directly or indirectly, by those citizens. People must file those claims within the time period the Commission announces in the Federal Register. That announced period cannot be more than eighteen months and the notice must be published within sixty days after October 16, 1964, or (for claims against the Chinese Communist regime) within sixty days after November 6, 1966, or within sixty days after Congress provides funding for the Commission for each program, whichever date is later. The Commission will decide how much each valid claim is worth under U.S. and international law. It will use the valuation method that fits the property and is fair to the claimant, such as market value, book value, going-concern value, or replacement cost. Claims for disability or death caused by those governments are handled the same way, but they must be filed within the announced period or within six months after the claim first arose, whichever is later.
