Blocks U.S. money from going to any foreign government that, on or after January 1, 1956, took over or seized the property of a United States person, canceled a contract with a United States person, or did something else that had the same effect (like unfair taxes). The ban applies unless, within the time limits below, the foreign government either returns the property, pays full and fair compensation in usable foreign currency or equivalent, offers a fair domestic way to get prompt compensation, or agrees to binding international arbitration. The President must also tell U.S. representatives at multilateral banks to vote against loans for any country under the ban, unless the money is for basic human needs. The ban ends when the President certifies in writing that one of the listed fixes has happened. The President may waive the ban for one year at a time if it serves the national interest and Congress is told. The time allowed for a government to act is the latest of these: 3 years after a claim was filed; for countries that were authoritarian when the action occurred, 3 years after a democratically elected government takes office; or 90 days after April 30, 1994. The rule does not cover countries set up by a U.N. mandate or U.S.-recognized disputed territories. The Secretary of State must report to Congress not later than 90 days after April 30, 1994 and each fiscal year on outstanding claims and related actions. A "United States person" means a U.S. citizen or an entity at least 50 percent owned by U.S. citizens. Special rules apply for actions by Nicaragua between January 1, 1956 and January 9, 2002 that require timely written submission to the State Department.
