Title 22 › Chapter CHAPTER 6— - FOREIGN DIPLOMATIC AND CONSULAR OFFICERS › § 257
A foreign consul or similar officer can ask a U.S. court, judge, or magistrate to help when a shipboard problem involves a crew member. The consul must give a written, sealed statement saying what happened, when and where, and must show certified ship papers proving the person is part of the crew. The statement must say the crew member has left or is about to leave the master's control or is refusing to obey the consul, and must say, to the consul’s best knowledge, that the person is not a U.S. citizen. If the court finds the paperwork in order, it must issue a warrant for the person’s arrest. The warrant goes to the U.S. marshal or to a U.S. citizen specially appointed to bring the person in for examination at a set time and place.
